The daysant licence

Excuse the more formal tone compared to the rest of the website. After all, this is a legal document.

You can:

  • use the work
  • modify the work and its source
  • distribute the work
  • make copies of the work
With +soft:
  • use any patents with the work

You can not:

  • hold the author liable
  • be a stock corporation
  • be the military or police (except in non-combatant purposes)
  • share any user data with third parties
  • impose further restrictions on use or distribution
With +ncom:
  • distribute a modified work for monetary compensation
  • distribute the original work

You must:

  • include a copy of the licence in all distributions
  • include some form of attribution to the original author
  • include some means to access the original work
With +soft:
  • include the source code or a means to access the source code
  • waive any patents you have on the software

This is not a substitute for the actual licence text.

Trademark rights are not granted by this licence. Unauthorised use of trademarks will make you liable for trademark infringement.

Licence text

1. Definitions

  1. The "licence" is defined as the daysant Licence, Revision 4.
  2. "Copyright" is defined as any laws or provisions that relate to copyright or are copyright-like.
  3. "You" are defined as any party who is a licencee. You may either be an individual or an organisation.
  4. The "author" is defined as any party who holds copyright on the work. This includes the original creator and all other contributors.
  5. The "work" is defined as the copyrightable work licenced under this licence.
  6. The "source" is defined as the form of the work that is used to make modifications to the work by the author.
  7. The "product" is defined as all other forms of the work.
  8. To "use" a work means to do anything with the work that, without the grants and permissions of this licence, would make you liable for copyright infringement.
  9. To “modify” a work means to adapt or copy a work, in whole or in part, other than the creation of a verbatim copy.
    1. The resulting work is the "modified work", based off the earlier work called the "original work".
  10. To “distribute” a work means to use the work which makes the work available to any third party in any way. The work can be a modified work or the original work.
  11. An “attribution method” refers to any one of a hyperlink, button, menu option, or any other mechanism by which parties who use the work can find information that is specified in later provisions of the licence.

2. Agreement to the licence

  1. By using, modifying, distributing, or copying this work, you agree to this licence in full.
  2. In the event you take part in any action that contradicts or violates the provisions of this licence, it immediately becomes void and you may be liable for copyright infringement.
  3. In the event that a particular clause of the licence is found to be unenforceable or otherwise legally invalid, you and the author agree to substitute it with an enforceable substitute that accurately replaces the original intent of the clause. This does not effect other clauses of this licence.

3. Terms of the licence

Permission is hereby granted, free of charge, to the use, modification, distributing, copying, and sub-licensing of the work, subject to the following conditions:

  1. The author is clearly attributed through an attribution method in the work.
  2. The original work can be found by an attribution method in the work.
  3. The work cannot be used, modified, or distributed for any purpose, directly or indirectly, by any party who is, is involved with, or benefits from:
    1. a stock corporation, regardless of private or public,
    2. a law enforcement or military organisation,
      1. This does not apply if used in non-combatant fields, for example, in medicine or first aid.
    3. an organisation involved in the dealing of arms or weapons, such as firearms, missiles, military vehicles, or systems involved in the operation of such.
  4. Any information collected through the work cannot be shared or exchanged with any third party, that is, any party that excludes you and any other parties using the work.
    1. This applies even if other parties using the work have agreed to allow this.
  5. This licence must be included with all copies of the work.
  6. No further restrictions, legal or technological, can be applied to the work such that it would prevent the further use or modification of the work.

4. Disclaimer of warranty

  1. The work is provided "as is", without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose and non-infringement.
  2. In no event shall the authors or copyright holders be liable for any claim, damages, or other liability, whether in an action of contract, tort, or otherwise, arising from, out of, or in connection with the work or the user of other dealings in the work.

5. Software annex

  1. The work must be distributed in one of the following ways:
    1. in source form,
    2. in product form, but with means on how to access the source,
      1. If found that the means to access the source no longer becomes available, it is your responsibility to amend this.
    3. in product form, but with a copy of the source.
  2. The author hereby irrevocably waives any and all patent rights they may have over the work or may acquire in the future related to the work. This waiver applies to every use, copying, modification, and distribution of the original work and modified works thereof.

6. Commercial annex

  1. The work must also not be used for any activities that involve any of the following:
    1. distribution of a modified version of the work in exchange for some monetary compensation,
    2. distribution of the original work, verbatim.

Applying the licence

There are four forms of the licence:

There have been three other versions of the daysant licence. All of them were pretty bad, so you should specify the fourth revision, ideally designated by R4.

The licence should be made well-known to users of the work. For example, a badge or a licence file.

Comment headers are particularly useful for software. Each file should have a header similar to:

    // path/to/file.ext
    // <a description of what the file does>
    // Copyleft (c) <year> <author name>.
    // This file is licensed under the daysant licence+soft R4.

You may note that the software and non-commercial annexes are included in the above copy and the downloads below. These are the +soft and +ncom variants. They can be removed if you do not wish to apply them.
